Poor lil’Tink Tink, a/k/a Lindsay Lohan — she just can’t seem to win. And her latest defeat is against Mr. 305 himself, Pitbull!

Hip-Hop Blog has the scoop: in 2011, Lohan sued Pitbull (born Armando Perez) for his reference to her in his song, “Give Me Everything.” (For those that don’t remember, the line that Pitbull used that was SO VERY HIGHLY OFFENSIVE to Lohan was “I got it locked up like Lindsay Lohan.”) Lohan claimed that Pitbull had no right to profit off of her name, because she didn’t give him clearance to do so. However, the New York Federal judge ruled in Pitbull’s favor, saying that the song is a “work of art” (let’s take it easy there, Your Honor…) and therefore protected under the First Amendment. The judge also dismissed Lohan’s claim that she suffered “extreme emotional distress” as a result of the mention in the song.
